General Terms and Conditions

§ 1 Scope

The terms and conditions regulate the legal relationships between the ticket purchaser and the Festspielhaus und Festspiele Baden-Baden gGmbH. They are an integral part of the contract regarding the purchase of admission tickets. With the purchase of an admission ticket to performances in the Festspielhaus Baden-Baden, the ticket purchaser understands and accepts the terms and conditions outlined hereafter as binding.

 

§ 2 Programme and starting times

The up-to-date programme including starting times will be announced in publications by and on the premises of the Festspielhaus und Festspiele Baden-Baden gGmbH, who also reserves the right to make cast and programme changes for good cause, provided they are reasonable. In particular, we reserve the right to make cast changes when an artist cancels, is taken sick, or cannot participate in the production due to other reasons. In this case care will be taken to ensure that the role will be recast with an artist of equivalent or at least almost equivalent calibre, particularly with regards to the degree of popularity and qualifications. We particularly reserve the right to make programme changes in the case that a programme item cannot be performed, making a change essential. In this case care will also be taken that the programme change does not lead to a considerable alteration with regards to the content.

 

§ 3 Ticket prices

The ticket prices can be taken from the respective valid price lists related to the event, that are announced in the publications by the Festspielhaus und Festspiele Baden-Baden gGmbH. Advanced sale and system fees are included in the respective ticket price, as is the statutory value-added tax, provided it is applicable.  
 

 

§ 4 Concessions

Concessions shall apply to the following groups of individuals for tickets in all categories: pupils, students, trainees, individuals completing their military or civilian service, holders of the Baden-Baden family pass, the unemployed, pensioners, and disabled persons (minimum degree of disability: 70%). Valid proof of status must be presented upon purchase and admission to qualify for concession tickets. Only one concession ticket may be purchased per status document. The Festspielhaus has no influence over concession arrangements for entertainment performances put on by external organisers.

While tickets for an event are not sold out a limited stock of tickets is offered to young people under the age of 29 at the price of 10 €.

 

§ 5 Seating categories

The seating arrangements published in the Festspielhaus Baden-Baden's publications shall be pertinent. A certain number of special seats is available for wheelchair users and an accompanying person in each case. Orders for such seats need to be placed separately with the Festspielhaus und Festspiele Baden-Baden gGmbH. Standing room tickets are only available at the box office on the evening of the performance once the performance is fully booked.

 

§ 6 Ticket sales

Entrance tickets can be purchased as follows:

  • At the box office of the Festspielhaus Baden-Baden from Monday to Friday, 9:30 a.m. to 6 p.m., and on Saturdays, Sundays and public holidays from 10 a.m. to 2 p.m. The Festspielhaus Baden-Baden box office is always open on event days from two hours prior to commencement of the performance.
  • By telephone via the Festspielhaus ticket hotline (+49(0) 7221- 30 13-101) from Monday to Friday, 9 a.m. to 6 p.m., and on Saturdays, Sundays and public holidays from 10 a.m. to 2 p.m., or by telefax at +49(0) 72 21-3013-211.
  • In writing from the Festspielhaus und Festspiele Baden-Baden gGmbH, Beim Alten Bahnhof 2, 76530 Baden-Baden, Germany.
  • Over the Internet at www.festspielhaus.de.
  • Throughout Germany via all authorised CTS advance booking offices and at selected travel agents.

 

§ 7 Ticket reservation

Tickets may be reserved within the scope of the available stock of tickets. The validity of the reservation is limited to a period of one week. This is pointed out with each reservation. Should this period be exceeded without any payment being made, the claim to tickets shall lapse and the reservation will be cancelled. Tickets that have not been paid for will not be sent out, and will also not be made available to the customer who made the reservation at the box office on the evening of the performance.

 

§ 8 Payments

The amount charged may be settled within the reservation period as follows. By credit card (Visa, American Express, Mastercard) giving details of the card number, date of expiry and check digit, or by direct debit giving details of the full address and order number. In addition, it is possible to pay at the Festspielhaus box office in cash or using an EC card. Tickets paid for will be sent to the customer, subject to a flat rate handling and shipping fee of EUR 5.00 per order. This is pointed out with each reservation. The tickets will be delivered by recorded delivery (not signed for).

 

§ 9 Exchange and taking back of tickets

No claim exists to be able to return or exchange tickets purchased. Changes in the cast and/or programme shall not entitle the holder of a ticket to exchange it or request a refund. By purchasing a certificate of insurance for € 5.00 the holder of the ticket will have a contractual right to return an entrance ticket purchased in the event of either the holder of the ticket or the accompanying person falling victim to a serious illness or accident. The declaration of withdrawal from the sales transaction is to be asserted by presenting a certificate of insurance, the original entrance ticket and a medical certificate. In order to assert the right of withdrawal, the Festspielhaus Baden-Baden needs to be informed about the circumstances of the case no later than two hours prior to commencement of the event for which the entrance ticket was purchased.

 

§ 10 Loss of tickets

No substitute is provided by the Festspielhaus und Festspiele Baden-Baden gGmbH in the case of lost entrance tickets.

 

§ 11 Passing on of entrance tickets

Reselling entrance tickets publicly and commercially is not permissible. The latter shall not apply to customers whose regular business activities also include reselling or arranging for entrance tickets or whose memorandum and articles of association stipulate passing on or arranging for tickets for members or other groups of persons.

 

§ 12 Cloakroom

Our guests are requested to hand in their coats and jackets at the cloakroom, as they may not be taken into the hall. Cloakrooms are located on the ground floor, as well as on the second and third floors.

 

§ 13 Late entry

After commencement of an event, customers may only, if applicable, enter the hall at points when there is a short break to let latecomers in. In this respect, it is absolutely necessary to pay attention to the staff's instructions.

 

§ 14 Leaving the event prematurely

Should the customer leave the performance hall or the event premises after being let in or to take a break, or should the tear-off section of the ticket be torn off by third parties appointed by the organiser, the ticket shall lose its validity.

 

§ 15 Premature termination of an event

An event which is conducted until an arranged break, and - for a significant reason - which is the not the fault of the organiser, cannot be continued after that, will be deemed to have been conducted in full and shall not give rise to any entitlement on the part of ticket holders to assert claims for compensation. The latter shall, however, only apply in the event of at least half of the time allocated to the event having passed by the time of the break. A significant reason shall in particular exist if there are any hazards on the premises (e.g. in the case of a fire alarm going off) or an artist cannot perform or continue to perform for health reasons.

 

§ 16 Cancellation of an event

If an event is cancelled for a significant reason, still prior to commencement of the event, the ticket price will be reimbursed. The claim to reimbursement of the ticket price needs to be asserted at the advance booking office where the tickets were purchased. In this respect, a deadline of six weeks is to be adhered to, commencing upon the day of the event that has been cancelled. Following expiry of the deadline, the ticket price will be reimbursed by the Festspielhaus und Festspiele Baden-Baden gGmbH within a further period of four weeks, less any fees, such as advance booking fees, system fees or handling charges. Following expiry of this period, the claim to reimbursement shall lapse. Any further claims against Festspielhaus und Festspiele Baden-Baden gGmbH shall be excluded.

 

§ 17 Children on the premises

The Festspielhaus und Festspiele Baden-Baden gGmbH's express prior consent is required for taking along children under six years of age. This provision shall not apply to events which are offered specifically for children or to attending the Kindermusikwelt Toccarion for children. Parents or any other individuals in charge of the children shall be liable for their children, and shall be responsible for both the occurrence of any damage to the facilities and equipment, and any injury to persons or damage to property of third parties.

 

§ 18 Liability

Unless the organiser is mandatorily liable for injury to persons, pecuniary losses and damage to property based on statutory provisions, any liability for such losses is excluded. Liability for damages shall be restricted to intent or gross negligence.

Also in the event of Acts of God and random damage, as well as defects which cannot immediately be recognised even when complying with the usual duty of care in regard to inspection, the Festspielhaus und Festspiele Baden-Baden gGmbH shall not be held liable in this respect.

 

§ 19 Video and sound recordings

By purchasing an entrance ticket, the customer declares that he or she is in agreement that the organiser takes and duplicates photos of the customer, identifying the customer as an attendee at the event, and publishes them in print and audio-visual media. This consent is given with no monetary consideration provided in return, as well as being unlimited in terms of duration and geographic scope of application. The customer is prohibited from recording audio, shooting film or video or taking photos during or in relation to the event.

 

§ 20 Opening hours

The foyer, as well as the bars, open 90 minutes prior to commencement of the event.

 

§ 21 Internal rules of the premises

By acquiring entrance tickets for events held at the Festspielhaus Baden-Baden the customer acknowledges the internal rules of the Festspielhaus und Festspiele Baden-Baden gGmbH, as well as the Hall regulations, as binding. Instructions issued by the staff need to be adhered to. The ticket is to be shown to our staff upon request at any time. It is not permissible to occupy a seat other than the one designated on the ticket. Entry to the Festspielhaus Baden-Baden shall not be permitted to individuals having infectious diseases or open wounds or to individuals who are under the influence of intoxicating substances.

Eating and drinking food that the customer has brought in is not permitted.

In the interests of safety, order and cleanliness, any measures taken and instructions given by staff are to be complied with. The staff authorised by the management for this purpose shall be entitled to enforce the internal rules within the Festspielhaus Baden-Baden if required. The staff have been authorised to ask any visitors jeopardising the safety, peace and order of the premises, making a nuisance of themselves to other visitors, violating the General Terms and Conditions of Business or failing to comply with instructions issued by the staff to leave the premises of the Festspielhaus Baden-Baden. The purchase price shall not be reimbursable in such cases.

 

§ 22 Ban on smoking

There is a ban on smoking in all public rooms of the Festspielhaus Baden-Baden.

 

§ 23 Data privacy

By buying a ticket, the visitor agrees to their personal data being stored. Any data gathered will be exclusively stored for personally attending to the Festspielhaus guests, despatching informative literature and making service offers in line with the data privacy provisions. These details will not be passed on to third parties. The foregoing consent may be revoked at any time.

 

§ 24 Revocation policy - right of revocation

When purchasing entrance tickets, travel tickets for the Festspielhaus Express and interval food packages, under Sec. 312g Paragraph 2 (9) of the German Civil Code (BGB) you shall have no right of revocation and no right to return items purchased.

Should you, as a consumer, purchase vouchers at our webshop at www.festspielhaus.de or by telephone from our service centre at +49(0)7221 3013-101, you will be entitled to revoke your contractual declaration within 14 days without giving reasons. The revocation period shall be 14 days as from the day on which you have, or a third party appointed by you who is not the postal service or other delivery enterprise has, taken possession of the goods.

In order to exercise your right of revocation, you need to notify us (Festspielhaus und Festspiele Baden-Baden gGmbH, Beim Alten Bahnhof 2, 76530 Baden-Baden, Germany, Tel.: +49(0)7221 3013-101/e-mail: info@festspielhaus.de) about your decision to revoke your contractual declaration by means of an unambiguous statement (e.g. a letter sent through the post or by telefax or e-mail). You may use the sample revocation form provided for that purpose, however this is not mandatory. It is deemed sufficient to keep the revocation deadline if you despatch the notification about exercising your right of revocation prior to expiry of the revocation deadline.

Consequences of revocation

If you revoke your contractual declaration, we are required to refund you any payments we have received from you, including the delivery costs (with the exception of any additional costs resulting from your having opted for a different kind of delivery than the cheapest standard delivery offered by us) without delay, and no later than 14 days as from the day on which the notification about your revocation of your contractual declaration was received by us. To effect such a refund, we shall use the same means of payment that you used when effecting the original transaction, unless we have expressly agreed with you to use a different means of payment. We will never charge you any fees for such a refund. We may refuse to make such a refund until such time as we have received the goods back or you have provided evidence that you have returned the goods, depending upon which date is earlier.

You are required to send back the goods or hand them over to us (Festspielhaus und Festspiele Baden-Baden gGmbH, Beim Alten Bahnhof 2, 76530 Baden-Baden, Germany, Tel.: +49(0)7221 3013-101/e-mail: info@festspielhaus.de) without delay, and in any event at the latest within 14 days of the day on which you notify us about the revocation of your contractual declaration. The deadline shall be deemed to have been kept if you despatch the goods prior to expiry of the 14-day deadline. You shall bear the direct costs of returning the goods. You only need to compensate any loss in value of the goods if such loss in value is attributable to your handling the goods in a way that is not necessary in order to check the quality, properties and functioning of them.

 

§ 25 Severability clause

Should any of the provisions of the present General Terms and Conditions of Business be invalid, in whole or in part, the validity of the remaining provisions shall not be affected thereby. Any invalid clause or sub-clause shall be replaced by a provision which most nearly approaches the invalid provision in its significance.
